Terms of Service

Welcome to Mind Sense. By downloading, installing, or using the Mind Sense mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

1. Wellness, Not Medical Treatment

IMPORTANT: Mind Sense is a general wellness and relaxation tool. It is NOT a medical device, psychotherapy, or a substitute for professional mental health diagnosis or treatment. The App provides AI-generated meditation and mindfulness content for relaxation purposes only.

2. Not a Crisis Service

CRISIS WARNING: Do not use Mind Sense in an emergency. If you are in crisis or having thoughts of self-harm, contact your local emergency services or a crisis hotline immediately. In the United States, call or text 988 (Suicide & Crisis Lifeline). Mind Sense is not designed or intended to respond to crisis situations.

3. No Guarantees of Outcome

Results vary from person to person. Mind Sense does not guarantee any specific outcome, improvement in mental health symptoms, or reduction in stress or anxiety. AI-generated content may be imperfect or not suited to your situation. Your experience depends on many factors outside our control.

4. AI-Generated Content

Meditation sessions are generated by AI and may contain inaccuracies, generic phrasing, or content that is not suited to your specific situation. Use your own judgment. If any content causes distress, discontinue use immediately and consult a licensed mental health professional.

5. Consult a Professional

For mental health concerns — including anxiety, depression, trauma, or thoughts of self-harm — consult a licensed mental health professional. Mind Sense is not a replacement for professional care.

6. Subscriptions and Payments

The App offers auto-renewing subscriptions through Apple’s App Store. Payment is charged to your Apple ID account upon purchase confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple ID settings. Refunds are handled by Apple according to their refund policy.

7. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use automated systems (bots, scrapers) to access the App
  • Submit content that is harmful, offensive, or infringes on others’ rights
  • Interfere with the proper functioning of the App or its servers

8. Intellectual Property

The App, including its design, code, images, meditation content, and features, is owned by Mind Sense, a product of SenseApps (Hugo Bazan LLC), and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

9. Limitation of Liability

To the maximum extent permitted by law, Mind Sense, a product of SenseApps (Hugo Bazan LLC), shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to any mental health outcomes, decisions made based on AI-generated content, or failure to seek professional care.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Account Deletion

You may delete your account and all associated data at any time by visiting sense-apps.co/delete-account or by using the “Delete Account” option in the app settings. Account data will be permanently removed within 30 days of confirmation.

12. Apple App Store — Additional Terms

If you downloaded the App from Apple’s App Store, the following additional terms apply:

  • Apple as Third-Party Beneficiary: These Terms are between you and SenseApps (Hugo Bazan LLC). Apple is not a party to these Terms and has no obligation to enforce them. Apple has no warranty or maintenance obligations for the App.
  • Apple EULA: Your use of the App is also subject to Apple’s standard End User License Agreement available at apple.com/legal/internet-services/itunes/dev/stdeula/
  • Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded products you own or control, subject to the Usage Rules set forth in Apple’s App Store Terms of Service.
  • Maintenance and Support: SenseApps (Hugo Bazan LLC), not Apple, is solely responsible for providing maintenance and support services for the App.
  • Product Claims: SenseApps (Hugo Bazan LLC), not Apple, is responsible for addressing any claims relating to the App or your use of it.
  • Third-Party Claims: In the event of any third-party claim that the App infringes a third party’s intellectual property rights, SenseApps (Hugo Bazan LLC), not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

13. Google Play Store — Additional Terms

If you downloaded the App from Google Play, the following additional terms apply:

  • Google as Third-Party Beneficiary: These Terms are between you and SenseApps (Hugo Bazan LLC). Google is not a party to these Terms.
  • Google Play Terms: Your use is also subject to Google Play Terms of Service.
  • Automatic Updates: The App may update automatically via Google Play.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
